These Terms of Use (“Terms”) govern your access to and use of the ParkJawn website, application, and related services (collectively, the “Service”).

ParkJawn is a product of Civic Synapse Technologies LLC, doing business as ParkJawn (“ParkJawn,” “we,” “us,” or “our”).

By accessing or using ParkJawn, you agree to these Terms. Where ParkJawn presents an account registration, beta enrollment, or other acceptance process, you may be required to affirmatively accept these Terms before proceeding.

If you do not agree to these Terms, you should not use the Service.

Parking Information Is Guidance

ParkJawn provides parking-related information, availability estimates, and navigation assistance intended to help users make more informed parking decisions.

ParkJawn may recommend particular streets, blocks, parking lots, garages, or other parking locations based on available information.

ParkJawn does not guarantee that a parking space will be available, legal, safe, accessible, affordable, or suitable when you arrive.

Parking availability and regulations may change at any time. Temporary restrictions, construction, street closures, permit requirements, enforcement activity, and other conditions may not be immediately reflected in ParkJawn.

Posted street signs, temporary restrictions, official notices, parking meters, property-owner rules, and applicable laws and regulations always take precedence over information provided by ParkJawn.

You are responsible for determining whether parking is lawful, authorized, and appropriate before parking your vehicle.

ParkJawn does not issue parking permits, reserve public parking spaces, grant permission to park on private property, or provide immunity from parking enforcement.

Changing Conditions and Information Delays

ParkJawn makes reasonable efforts to provide accurate, timely, and useful parking information. However, parking conditions, traffic patterns, road accessibility, construction activity, temporary restrictions, enforcement practices, and local conditions may change rapidly and without notice.

Information displayed by ParkJawn may be delayed, incomplete, outdated, or inaccurate due to limitations in available data, reporting delays, technical issues, or circumstances beyond our control.

Information may also be affected by GPS or positioning inaccuracies, temporary service interruptions, delayed community observations, or changes that have not yet been reflected in public or third-party data sources.

Users must always observe their surroundings, follow posted street signs and traffic regulations, and independently verify actual conditions before making driving or parking decisions. Real-world conditions and applicable laws always take precedence over ParkJawn's recommendations.

ParkJawn does not guarantee that its information reflects every recent change in parking availability, restrictions, traffic patterns, road accessibility, or local conditions.

Drive Safely

ParkJawn is an informational and navigation-assistance service. It is not a substitute for driver attention, judgment, or compliance with traffic laws.

Your attention must remain on the road at all times while driving. Always obey traffic laws, traffic signals, posted street signs, parking regulations, and actual road conditions, even when ParkJawn provides different or conflicting information. Never follow a ParkJawn recommendation or navigation instruction that would require unsafe or unlawful behavior.

Do not interact with ParkJawn in a manner that distracts you while driving.

Drivers must remain attentive to their surroundings, maintain control of their vehicles, obey traffic signals and laws, and follow lawful instructions from traffic-control authorities.

When necessary, use ParkJawn only after safely stopping your vehicle or have a passenger operate the Service.

Navigation directions, parking recommendations, and suggested routes must not be followed when they are unsafe, unlawful, blocked, inaccessible, or inconsistent with actual road conditions.

Driving and searching for parking involve inherent risks, including traffic collisions, pedestrian conflicts, personal injury, and property damage.

You remain responsible for your driving decisions, vehicle operation, and parking decisions, subject to applicable law.

Navigation and Routing Information

ParkJawn may provide driving directions, walking directions, estimated arrival times, suggested approaches to parking locations, and other navigational assistance.

Navigation information may be based on third-party mapping services, geographic data, road networks, and other sources.

Routes may be incomplete, inaccurate, outdated, or affected by traffic conditions, road closures, construction, vehicle restrictions, or other circumstances.

ParkJawn does not guarantee the accuracy or safety of any route, entrance, turn, travel time, or navigational instruction.

Users must independently determine whether a route is safe, legally permitted, and appropriate for their vehicle and circumstances.

ParkJawn is not responsible for unsafe or unlawful driving decisions made in reliance on navigation guidance, except to the extent liability cannot lawfully be excluded.

Data and Predictions

ParkJawn may use public information, historical parking data, geographic information, community reports, statistical models, algorithms, device-derived observations, and other information to generate parking guidance.

Parking conditions can change rapidly, and information from third parties, public databases, automated systems, or other users may be incomplete, delayed, inaccurate, or unavailable.

Parking availability probabilities, confidence levels, rankings, recommendations, and similar outputs represent estimates rather than confirmed parking availability.

A high parking-availability estimate does not guarantee that a parking space exists, is unoccupied, or may legally be used.

ParkJawn may also provide information about parking restrictions, permits, meters, construction, road closures, and related conditions. This information may not include every applicable restriction or reflect changes immediately.

Users must verify current conditions and applicable regulations before parking.

Private Parking Lots and Garages

ParkJawn may identify or recommend public, private, commercial, customer, visitor, event-related, or other off-street parking facilities.

Facilities may have access restrictions, limited operating hours, parking fees, reservation requirements, customer-only conditions, permit requirements, or other eligibility restrictions.

A parking facility's appearance in ParkJawn does not mean the facility is open to the general public or that every user is authorized to park there.

Displaying a parking lot or garage does not constitute permission to enter, a parking reservation, or a guarantee of access or availability.

Users are responsible for verifying posted rules, pricing, operating hours, access restrictions, and authorization requirements.

Parking facility operators retain control over their properties and applicable parking conditions.

Unless expressly stated otherwise, ParkJawn does not own, operate, manage, or control the parking facilities displayed through the Service.

Parking Tickets, Towing, and Enforcement

ParkJawn may attempt to identify parking restrictions and areas where parking appears to be permitted.

However, not all parking restrictions, temporary notices, enforcement conditions, or changes in local regulations may be reflected in its information.

Reliance on ParkJawn does not excuse violations of parking laws, traffic regulations, posted restrictions, or private-property rules.

Users are responsible for independently confirming whether parking is authorized and for applicable parking citations, fines, towing charges, impoundment expenses, parking fees, and related consequences, subject to applicable law.

ParkJawn does not guarantee protection from citations, towing, vehicle immobilization, or other parking enforcement actions.

Community Contributions

Certain ParkJawn features may allow users to submit parking-related observations, feedback, or other information.

Examples include reports that a user found parking, left a parking space, or could not find parking.

You agree not to knowingly submit false, misleading, unlawful, abusive, or fraudulent information or attempt to manipulate ParkJawn's reporting or recommendation systems.

ParkJawn may evaluate, aggregate, filter, adjust, disregard, or remove submitted reports to improve service reliability and prevent misuse.

Community reports may influence parking predictions but are not independently guaranteed to be accurate.

You retain ownership of original content you submit, subject to any rights belonging to others. By submitting parking-related observations or feedback, you grant ParkJawn a nonexclusive, royalty-free license to process, reproduce, analyze, and use that information as reasonably necessary to operate, maintain, and improve the Service, subject to our Privacy Policy and applicable law.

We may restrict or remove access to features when reasonably necessary to protect ParkJawn, its users, or the integrity of its information.

Automated Parking Observations

ParkJawn may offer optional features that use device positioning and movement-related information to help identify potential parking arrivals, departures, or other parking-related events.

These features may include Smart Arrival, Smart Departure, and other parking-detection technologies.

Automated observations are estimates and may incorrectly identify parking-related activity.

An inferred arrival or departure does not guarantee that a parking space is occupied, vacant, legally available, or suitable for use.

Certain features may require device permissions or additional user authorization.

These Terms do not independently authorize background location collection or access to sensitive device information. Such processing is addressed in our Privacy Policy and any applicable permission or consent process.

Beta and Experimental Features

ParkJawn is under active development. Beta, testing, or experimental features may change, malfunction, produce inaccurate results, become unavailable, or be discontinued.

Experimental features may include parking predictions, navigation functionality, automated parking detection, and technologies that evaluate GPS, GNSS, or other permitted positioning information.

Participation in beta testing does not guarantee continued access to ParkJawn or any particular feature.

Users acknowledge that experimental functionality may not perform consistently or achieve its intended results.

ParkJawn may modify, suspend, or discontinue experimental features as the Service develops.

Third-Party Services and Information

ParkJawn may incorporate or provide access to information or services from third parties, including mapping providers, routing providers, parking operators, government agencies, public-data sources, and other technical service providers.

We do not control all third-party information or services and cannot guarantee their accuracy, availability, completeness, or continued operation.

Third-party services may be subject to additional terms, conditions, and privacy policies.

References to government agencies, public datasets, parking operators, or other organizations do not imply endorsement, affiliation, sponsorship, or partnership unless expressly stated.

ParkJawn is an independent parking-information service and is not a governmental parking authority.

Acceptable Use

You may use ParkJawn only for lawful purposes.

You may not:

• Intentionally interfere with the Service or its infrastructure.

• Attempt to bypass security measures or access controls.

• Submit fraudulent or deliberately misleading parking reports.

• Access nonpublic data or accounts without authorization.

• Use unauthorized automated methods to extract or manipulate ParkJawn information.

• Copy, redistribute, or commercially exploit protected ParkJawn software or proprietary information without authorization.

• Use ParkJawn in a manner intended to harm the Service, other users, or third parties.

These restrictions do not prohibit activities protected by applicable law.

ParkJawn may suspend or restrict access when reasonably necessary to address security threats, fraud, unlawful conduct, or violations of these Terms.

Intellectual Property

ParkJawn, including its name, branding, logos, software, user interface, original content, proprietary algorithms, designs, and other protected materials, is owned by Civic Synapse Technologies LLC or used with permission, except for third-party materials and information.

These Terms do not transfer ownership of ParkJawn or its intellectual property to you.

Subject to compliance with these Terms, ParkJawn grants users a limited, nonexclusive, nontransferable, revocable permission to access and use the Service for its intended purposes.

Third-party geographic information, maps, and other licensed materials remain subject to their respective ownership rights, licenses, and attribution requirements.

Nothing in these Terms grants ownership or exclusive rights in public information or materials that are not legally protectable.

Disclaimer of Warranties

To the fullest extent permitted by applicable law, ParkJawn is provided on an “as is” and “as available” basis.

We do not guarantee uninterrupted operation, complete accuracy, continuous availability, error-free performance, or that the Service will meet every user's requirements.

We make no guarantee concerning the availability, legality, accessibility, safety, accuracy, or suitability of any recommended parking location.

To the fullest extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and noninfringement, together with other warranties that may lawfully be disclaimed.

Nothing in this section affects warranties or other rights that cannot legally be excluded.

Limitation of Liability

ParkJawn provides informational and navigational assistance and does not control the actions of drivers, parking authorities, property owners, other road users, or third-party service providers.

To the fullest extent permitted by applicable law, Civic Synapse Technologies LLC, doing business as ParkJawn, and its officers, employees, agents, and representatives will not be liable for indirect, incidental, special, consequential, punitive, or similar damages arising from use of or reliance on the Service.

This includes, where legally permissible, losses associated with:

• Parking tickets, fines, towing, or impoundment.

• Unavailable, inaccessible, or restricted parking.

• Incorrect parking estimates or recommendations.

• Navigation inaccuracies or route disruptions.

• Vehicle damage, traffic collisions, or property damage.

• Personal injury arising from driving or parking incidents.

• Missed appointments, lost time, travel delays, or lost business opportunities.

• Inaccurate, outdated, or unavailable third-party information.

• Service interruptions or experimental feature failures.

Users remain responsible for operating their vehicles safely and complying with applicable traffic and parking regulations.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for conduct or injuries where such limitations are prohibited by applicable law.

The limitations in this section apply only to the extent enforceable under applicable law.

Privacy and Location Information

ParkJawn's collection, use, sharing, and retention of personal information are described in our Privacy Policy.

Certain optional features may request location permissions or access to permitted device positioning measurements.

Users are responsible for reviewing applicable device permissions and may disable optional features as permitted by their device or application settings.

Acceptance of these Terms does not replace any separate permission or consent required for collecting or processing sensitive information.

Changes to ParkJawn or These Terms

We may modify ParkJawn or update these Terms as the Service develops.

If these Terms are updated, we will revise the “Last Updated” date above.

We may provide additional notice of material changes through the website, application, or other appropriate communication channels.

Where legally permitted and after appropriate notice, continued use of ParkJawn following the effective date of updated Terms may constitute acceptance. Where required by law, we will obtain affirmative agreement to materially revised terms.

Governing Law

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-law principles, except where applicable law requires otherwise.

Nothing in these Terms limits any nonwaivable legal protections available to consumers under applicable law.

Severability

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.
